Convicted Killer Serving Life Wants Trial Re-opened

by Sammy Edmonds posted Jan 2 2014 11:31AM
He committed one of the most brutal slayings in Muncie's history...now he wants his case re-opened.

The Star Press reports 32-year-old Christopher Burns has filed a petition for post-conviction relief, saying his conviction and sentence violated the U.S. Constitution because Burns was denied trial counsel.

Burns was convicted at age 19 in the slaying of Tammie Craycraft Smith.  He had befriended the co-worker, then robbed her after stabbing her repeatedly in her apartment in 2001.

A hearing has not yet been scheduled on the motion.  Delaware County Prosecutor's chief trial deputy Eric Hoffman says they will contest any effort by Burns to overturn his life sentence.
