A Mis-Trial was declared Tuesday in the trial of a Muncie man before the first witness was ever called to the stand.
26-year old Terrence Douglass is accused of killing Jamel Barnes in October of 2012. A jury had been seated Monday to hear the case in Delaware County Circuit Court, but Judge Linda Wolfe declared a mis-trial when she learned that Douglass’s attorneys had represented a man they planned to claim actually killed Barnes.
The conflict of interest meant the case will have to be re-scheduled and that Douglass will have to get a new set of attorneys to represent him. That means it could be late summer before the case actually goes to trial.
