The City of Marion is getting ready to go to court.
After the Indiana Supreme Court accepted the city’s appeal in the ongoing Old Y case last month, arguments on the case are now scheduled for Thursday, Nov. 19 at 10 a.m.
Arguments will be held remotely and will be streamed online. They are all set to be 40 minutes in length with 20 minutes per side
According to the Indiana Supreme Court’s website, “In 2016, the City of Marion filed a complaint in Grant Superior Court against parties involved in a stalled redevelopment project partially funded by a municipal bond. Discovery uncovered allegations of misuse of bond funds by the mayor who left office the previous year. In 2017, the City amended its complaint to add London Witte Group, LLC (LWG), an accounting and financial services firm employed by the previous mayor’s administration, and the mayor’s brother as defendants. The trial court granted summary judgment in LWG’s favor on two of the three claims against it. The Court of Appeals affirmed in part and reversed in part, finding all of the claims against LWG time-barred. City of Marion v. London Witte Group, LLC, 147 N.E.3d 362 (Ind. Ct. App. 2020), vacated. The Supreme Court has granted transfer and accepted jurisdiction over the appeal.”
